ARTIST TERMS AND CONDITIONS

Introduction

Welcome to the Bath Contemporary Artists’ Fair (BCAF). By offering your artwork for sale on our platform, you’re entering into a contract with us, governed by these Terms and Conditions. It’s important you read and understand them, as they outline both our obligations and yours.

1. Definitions

  • Artist: You, whether an individual or an entity, selling artwork on our site.
  • Artwork: Items you’re selling, including commissions and custom pieces.
  • Buyer: Anyone purchasing artwork from you through our site.
  • BCAF Services: What we provide, including showcasing your artwork and facilitating sales.
  • Website: bcaf.co.uk, where your artwork will be listed.
  • Consumer Rights: Defined by the Consumer Rights Act 2015, pertaining to purchasers outside their trade or business activities.

2. Artist and Artwork Acceptance

  • Submission: Your artwork must be approved by us to be listed for sale.
  • Responsibilities: You confirm that your artwork is original, you can provide authenticity certificates, and you’re responsible for it until delivery. You also ensure compliance with all relevant laws.
  • Collaboration: Clear images and accurate descriptions of your artwork are crucial. For help, contact info@bcaf.co.uk.

3. Payments and Commission

  • Commission: We take a 30% commission on sales. Listing is free.
  • Pricing: You’re responsible for setting your sale prices, considering all relevant costs (tax, packing, shipping and insurance).
  • Process: After a sale, we deduct our commission and process your payment within 28 days.
  • Refunds: Handling refunds is your responsibility, adhering to our guidelines. Commission will not be paid on refunded sales.

4. Delivery

  • Standard: Arrange delivery within 5 working days of sale, ensuring the artwork is insured and trackable.
  • Notification: Inform us immediately of any delivery delays.
  • Packaging: Artwork must be securely packaged, with required  certificate of authenticity where applicable.

5. Handling Sales Issues

  • Damages: Address any delivery damages with your carrier, offering the buyer a suitable resolution.
  • Returns: Work directly with buyers to resolve issues, keeping us informed.
  • Refunds: Process refunds promptly, within 2 working days of your decision, in line with our guidelines.

6. Account Closure

  • Procedure: To close your account, notify us via email with 5 working days notice.
  • Post-Closure: We’ll remove your listings, but you must complete any outstanding sales or issues.
  • Final Payments: We’ll process any final payments 60 days after your account is closed.

7. General Terms

  • Changes: We reserve the right to modify these Terms and Conditions. It’s your responsibility to stay updated.

Space Guide

  • Standard Space (2.5m x 2m)
  • Standard Space + table (2.5m x 2m, table approx 185cms x 75cms)
  • Professional Stand – 1m deep x 2m wide x 2.3m high. The stands are covered in black fabric and can be nailed or screwed into. The stands also come with a table and black table cloth.
